Your Legal Position as an Heir
If you were not a co-borrower on the loan, you are not personally liable for the mortgage debt. The lender cannot pursue your personal finances to collect. What they can do is pursue the property , meaning the house is at risk, even if your credit and savings are not.

Federal Protections You Probably Don’t Know About
Under the Consumer Financial Protection Bureau’s mortgage servicing rules, “successors in interest” , people who have inherited or otherwise acquired a property , have specific legal rights. A servicer must communicate with you, provide you with information about the loan, and allow you to pursue loss mitigation options, even if your name is not on the mortgage.
To invoke these rights, you generally need to notify the servicer of the homeowner’s death and provide documentation , a death certificate and proof of your status as an heir or executor. Once you do, the servicer is required to work with you, not around you.
What You Should Say , and What You Shouldn’t
When you contact the servicer, keep it factual and documented. State your name, your relationship to the deceased, and that you are calling to notify them of the death and identify yourself as a successor in interest. Ask for the correct department , usually called loss mitigation or successor services , and request a written confirmation of next steps.
What you should avoid: making any verbal commitments about paying the mortgage, admitting that the estate owes a specific amount, or agreeing to any repayment terms before you’ve consulted with an attorney or advisor who can review the full picture.
Should You Even Answer the Calls?
If you’re not yet ready to engage, you are not required to answer calls on a debt that isn’t yours personally. But ignoring the situation entirely has real costs , the foreclosure process will continue with or without your participation.
The better play: get your bearings, open probate if needed, and then reach out proactively on your own terms. Coming to the bank before they come to you puts you in a stronger position.
